5 Steps for the Eviction Process

If you manage rentals long enough, you will, at last, have to evict a renter for your land. Step 1: Written Notice

Step 2: Filing

Step 3:  Hearing

When the document is filed, your tenant receives notice from the court that they must appear for a hearing and they must attend on the date. All of the states will rule to assign a court date for all person to appear and duke it out, presenting proof and making a case before a judge.

However, some states have required the tenant to conflict the infelicity once (usually via social media). If they do this task within the time window, a court date is scheduled for all parties to appear.  If the tenant did not get to answer in the time allotted, the eviction order is automatically granted.

Step 4: Lockout

Each state has its procedure for formal lockouts as well, surprise!

Several courts offer a period of appeal. Most of the country’s, the appeal time after a judge renders his decision is ten days. This means that each party may file a motion to a higher court at any time within the ten days. Most importantly, each court counts days in their own rules!. If the judge approves the eviction, and any appeal period has been drained, the procedure for a constable or Sheriff permit a lockout may begin.

Once the Sheriff decided and assigned an eviction schedule, the landowner has to serve or post it on the tenant. Allows the tenant to leave home. That means all homeowner have this right to get remove the tenants.

Step 5: Evicting the Tenant

If all the process goes appropriately in court and cases it probably will; then your tenant has got time to get out from your home or land it most probably in 48 hours and more.

If your tenant doesn’t hear you and leave on time, then you have the right to get someone from the Sheriff’s department to escort them out and place their possessions on the curb. It’s not a favourable outcome, but it does happen.
